2. Conclusion of the contract<\/b><\/h3>

2.1. The rental contract is concluded through an online reservation on the Service Provider\u2019s website and payment of the full rental fee.<\/span><\/p>

2.2. Finalization of the payment constitutes full acceptance of these GTC.<\/span><\/p>

2.3. The contract is concluded electronically and qualifies as a written agreement.<\/span><\/p>

2.4. Rental is available exclusively to guests of the K\u00c9GLI apartment house.<\/span><\/p>

\u00a0<\/h3>

3. Subject of the rental<\/b><\/h3>

The Service Provider rents out electric-assisted bicycles.<\/span><\/p>

Fleet:<\/span><\/p>

KTM Macina Cross CX 625<\/span>
<\/span>KTM Macina Team XL<\/span>
<\/span>KTM Macina Team 793<\/span>
<\/span>KTM Macina Style 730<\/span><\/p>

The Service Provider is entitled to provide a bicycle of the same category and technically equivalent.<\/span><\/p>

\u00a0<\/h4>

4. Rental fee<\/b><\/h4>

The rental fee is the current price published on the website.<\/span><\/p>

No deposit is required.<\/span><\/p>

The absence of a deposit <\/span>does not limit the liability of the renter.<\/b><\/p>

\u00a0<\/h3>

5. Handover<\/b><\/h3>

5.1. The bicycle is handed over to the renter in person.<\/span><\/p>

5.2. By taking over, the renter acknowledges that<\/span><\/p>

  • the bicycle is operational<\/span><\/li>
  • the technical condition is satisfactory<\/span><\/li>
  • no visible damage was observed<\/span><\/li><\/ul>

    5.3. If the renter does not report any defect at the time of handover, they cannot later refer to it.<\/span><\/p>

    5.4. During handover, the Service Provider presents the basic use and safety features of the bicycle.<\/span><\/p>

    \u00a0<\/h3>

    6. Mandatory conditions of use<\/b><\/h3>

    6.1. Wearing a helmet is mandatory during the entire rental period.<\/span><\/p>

    6.2. Use of the provided bicycle lock is mandatory at every parking.<\/span><\/p>

    6.3. The bicycle may only be used in compliance with road traffic regulations.<\/span><\/p>

    6.4. In case of using a child seat<\/span><\/p>

    • the child must wear a helmet<\/span><\/li>
    • the child\u2019s weight must not exceed 22 kg<\/span><\/li><\/ul>

      6.5. Failure to use mandatory safety equipment constitutes a serious breach of contract.<\/span><\/p>

      \u00a0<\/h3>

      7. Improper use<\/b><\/h3>

      The bicycle may only be used for its intended purpose.<\/span><\/p>

      It is particularly prohibited to<\/span><\/p>

      • jump or use for extreme sports<\/span><\/li>
      • use excessively off-road<\/span><\/li>
      • carry two persons simultaneously (except child seat)<\/span><\/li>
      • immerse the bicycle in water<\/span><\/li>
      • tamper with the electrical system<\/span><\/li>
      • transfer the bicycle to a third party<\/span><\/li>
      • use under the influence of alcohol or mind-altering substances<\/span><\/li><\/ul>

        Violation of the above rules results in full liability for damages.<\/span><\/p>

        \u00a0<\/h3>

        8. Alcohol and mind-altering substances<\/b><\/h3>

        8.1. The bicycle may only be used in a condition in which the renter is capable of safe operation.<\/span><\/p>

        8.2. The renter acknowledges that cycling under the influence of alcohol or any mind-altering substance significantly increases safety risks.<\/span><\/p>

        8.3. If the renter uses the bicycle in a condition that affects or impairs safe operation, it qualifies as improper use.<\/span><\/p>

        8.4. In case of<\/span><\/p>

        • accident<\/span><\/li>
        • injury<\/span><\/li>
        • technical damage<\/span><\/li>
        • damage caused to a third party<\/span><\/li><\/ul>

          occurring under the influence of alcohol or mind-altering substances, the renter bears full financial and legal responsibility and must compensate all damages and related costs.<\/span><\/p>

          8.5. The Service Provider is entitled to classify such use as a serious breach of contract.<\/span><\/p>

          The renter acknowledges that in such cases the Service Provider\u2019s claims may be enforced without dispute.<\/span><\/p>

          \u00a0<\/h3>

          9. Full liability<\/b><\/h3>

          9.1. The renter bears full, unlimited financial liability from takeover until return of the bicycle.<\/span><\/p>

          9.2. Liability is objective and exists regardless of fault.<\/span><\/p>

          9.3. Liability particularly covers<\/span><\/p>

          • mechanical damage<\/span><\/li>
          • frame damage<\/span><\/li>
          • electronic failure<\/span><\/li>
          • battery damage<\/span><\/li>
          • theft<\/span><\/li>
          • loss<\/span><\/li>
          • and damage caused by third parties<\/span><\/li><\/ul>

            9.4. The Service Provider is not required to prove fault on the part of the renter.<\/span><\/p>

            \u00a0<\/h3>

            10. Accessories<\/b><\/h3>

            Accessories provided with the bicycle<\/span><\/p>

            • helmet<\/span><\/li>
            • bicycle lock<\/span><\/li>
            • lamp<\/span><\/li>
            • child seat<\/span><\/li><\/ul>

              form part of the rental.<\/span><\/p>

              In case of loss, damage or destruction, the renter must pay replacement costs.<\/span><\/p>

              Replacement values:\u00a0<\/span><\/p>

              • Helmet - 30.000.-Ft per item<\/span><\/li>
              • Lock - 15.000.-Ft per item<\/span><\/li>
              • Lamp - 2.000.-Ft per item<\/span><\/li>
              • Child seat - 40.000.-Ft per item<\/span><\/li><\/ul>

                \u00a0<\/h3>

                11. Return<\/b><\/h3>

                11.1. The renter must return the bicycle at the end of the rental period.<\/span><\/p>

                11.2. In case of late return, the Service Provider may charge a proportional rental fee.<\/span><\/p>

                11.3. After return, the Service Provider is entitled to carry out a detailed technical inspection.<\/span><\/p>

                11.4. Hidden defects, internal damages and electronic faults may be enforced subsequently.<\/span><\/p>

                \u00a0<\/h3>

                12. Theft<\/b><\/h3>

                12.1. In case of theft, the renter must<\/span><\/p>

                • immediately notify the Service Provider by phone<\/span><\/li>
                • file a police report<\/span><\/li>
                • provide official documentation<\/span><\/li><\/ul>

                  12.2. If the bicycle was not locked with the provided lock, full replacement value is payable.<\/span><\/p>

                  13. GPS and tracking<\/b><\/h3>

                  The bicycles <\/span>may be equipped with GPS tracking or other identification systems for security reasons.<\/b><\/p>

                  The renter acknowledges that in case of theft or disappearance, the Service Provider is entitled to determine the location of the bicycle.<\/span><\/p>

                  \u00a0<\/h3>

                  14. Recovery and transport costs<\/b><\/h3>

                  If the bicycle becomes unusable due to technical failure, an accident or improper use, the cost of transport or recovery from the location is borne by the renter.<\/span><\/p>

                  \u00a0<\/h3>

                  15. Replacement values<\/b><\/h3>

                  625 Wh model: 1.400.000 Ft<\/span>
                  <\/span>750 Wh trekking: 1.700.000 Ft<\/span>
                  <\/span>750 Wh MTB: 1.900.000 Ft<\/span>
                  <\/span>750 Wh premium: 2.200.000 Ft<\/span><\/p>

                  Battery: 350.000 Ft<\/span>
                  <\/span>Motor: 350.000 Ft<\/span>
                  <\/span>Display: 80.000 Ft<\/span><\/p>

                  The renter must pay the full market cost of repair or replacement.<\/span><\/p>

                  \u00a0<\/h3>

                  16. Identification stickers<\/b><\/h3>

                  The bicycles have unique identification stickers and\/or hidden markings.<\/span><\/p>

                  Removal or manipulation<\/span><\/p>

                  • 50.000 Ft penalty<\/span><\/li>
                  • full liability for damages<\/span><\/li>
                  • may result in official proceedings<\/span><\/li><\/ul>

                    \u00a0<\/h3>

                    17. Child seat<\/b><\/h3>

                    The child seat is provided free of charge.<\/span><\/p>

                    Its use is solely the responsibility of the renter.<\/span><\/p>

                    The Service Provider is not liable for<\/span><\/p>

                    • injury to the child<\/span><\/li>
                    • loss of balance resulting from use<\/span><\/li>
                    • damage caused by improper installation<\/span><\/li><\/ul>

                      \u00a0<\/h3>

                      18. Extraordinary event<\/b><\/h3>

                      In case of any accident, technical failure or irregularity, the renter must immediately notify the Service Provider by phone.<\/span><\/p>

                      Failure to do so constitutes a serious breach of contract.<\/span><\/p>

                      \u00a0<\/h3>

                      19. Personal injury and insurance<\/b><\/h3>

                      The bicycles have insurance that covers damages arising from proper use; any damages beyond this are borne by the renter.\u00a0<\/span><\/p>

                      The renter uses the bicycle at their own risk.<\/span><\/p>

                      The Service Provider is not liable for<\/span><\/p>

                      • personal injury of the renter<\/span><\/li>
                      • injury to third parties<\/span><\/li>
                      • consequences of accidents arising from use of the bicycle<\/span><\/li><\/ul>

                        \u00a0<\/h3>

                        20. Legal disputes<\/b><\/h3>

                        The parties shall primarily settle disputes amicably.<\/span><\/p>

                        If this does not lead to a result, the court having jurisdiction over the Service Provider\u2019s registered seat shall be competent.<\/span><\/p>

                        \u00a0<\/p>

                        By completing the e-bike reservation, I accept the Terms and Conditions and confirm that I have read and understood them. I acknowledge that I use the bicycle at my own risk and assume full financial responsibility for it.
